Terms and Conditions
essentialofaquacycling.com (here in after referred to as “the Site”) is published by Christophe Jennequin (here in after referred to as the “Publisher”), under license to the system of auto-entrepreneur, 8 rue des compagnons 40230 SAINT VINCENT DE TYROSSE – FRANCE.
All orders placed on the Site are subject to these terms and conditions of sale.
The Publisher reserves the right to adapt or modify at any time, the version of the general terms and conditions applicable to any transaction that is listed online at essentialofaquacycling.com when ordering.
I – The Client
The Customer is a person aged at least 18 years old and have the legal capacity or holds parental authorization to place an order on the Site. In case of error in the address of the recipient, the Publisher can not be held responsible for failure to deliver the product.
II – Products
The products offered for sale are as described on the Site. The publisher takes great care in the presentation and description of the products to best meet the client information. It is possible that non-substantive errors may appear on the Site that the Customer acknowledges and accepts. In any event, in case of non-compliance of the product delivered to its description on the Site, the Customer will implement its certification that the Publisher shall, if either exchange a refund of the price (in whole or in part) may be charged.
III – The Command
Taking control of the Site is subject to the procedure established by the Publisher embodied in a series of steps that the client must follow to validate the order. V – Payment

If paying by bank transfer, the order will be processed upon receipt thereof.
The data recorded and stored by the Publisher are the proof of the order and all transactions. Data recorded by the payment system constitutes proof of financial transactions.
VI – Delivery
The products ordered are sent to the delivery address specified by the customer when placing the order.
The participation fee of logistical preparation and shipping means € 0.1 incl. All deliveries are announced by email.
The maximum delivery time is seven days after ordering the product on the site for downloads or after the time of cashing the check.
In case of delay in the delivery of more than seven days, if it is not due to a case of force majeure, the customer has the option to cancel the order.
It will follow the refund of the order within thirty days.
The products can be delivered in PDF format via email.
A confirmation email delivery and giving access to the Customer ordered products will be sent to the Client by the Publisher. To this end, the customer formally accepts the use of electronic mail for delivery by Publisher content of the order. An invoice will be emailed by the Publisher upon customer request.
Delivery is made to the email address specified by the customer when ordering. So that delivery can be made, the Customer must ensure that they have provided accurate and complete information regarding the delivery address.
The times indicated are target dates, corresponding to the average processing time and delivery. The publisher can not be held responsible for the consequences of a delay in delivery is not of his doing.

VII-Right of withdrawal

Customer hereby expressly acknowledges that he loses his right of withdrawal upon delivery by the Editor of the product ordered. There is no possibility of return to the Publisher the downloaded product.
VIII – Copyright
Graphic creations component digital products sold on the Site are the property of their author. Buying a product on the Website does not transfer in any way to the Customer the right to change, reproduction and distribution of the said artwork.
IX – Refund
Refunds for products in the cases referred to in Article II shall be made by the Publisher within a maximum period of 30 days after receipt by it of the Customer’s request. Refunds will be made using the same method of payment chosen by the customer when ordering.
X – Applicable law
Any order implies full acceptance of the Customer the terms and conditions of Sale. These terms and conditions are governed by French law. In case of dispute, the French courts will have jurisdiction. In case of problem or complaint at the time of an order, the Customer may contact the Publisher to find an amicable solution.
XI – Data Protection
The information collected by the Publisher at a Customer’s order is required to manage the transaction. The Customer is informed that these personal data may also be collected by an agency in charge of analyzing orders and the fight against fraud credit card. In accordance with the Data Protection Act 78-17 of 6 January 1978, the Customer has a right of access, rectification, opposition and deletion of data.
XII – Amendments to the General Terms and Conditions
The Publisher reserves the right to adapt or modify at any time these terms and conditions of sale. If modified, it will be applied to each order the general terms and conditions in force at the date of the order.
